Terms & Conditions

The allalin-apartments.ch (.com; .fr; .co.uk; .de)  website (the “Site”) is owned by Allalin Apartments, (“Allalin Apartments”, “Us” or “We”), as a service to our users and visitors. This service consists of online tools and features for the purposes of enabling users of our Site to conclude rental transactions in relation to accommodations (collectively our “Service”) accessible on www.allalin-apartments.ch.

1.         Acceptance of Terms

1.1   By accessing our Site and/or using our Site and Services, a person who requests a booking of a listed holiday rental property via the Site (“Guest”) (“User”, “You”, “Your”), these Terms apply between You and Allalin Apartments and govern the terms of Your use as User of the Site and You agree to be bound by these terms of use, including the terms of our Privacy Policy, which You acknowledge to have read and understood. Please note, however, that the legal contract for the supply of accommodation and rental transactions is between Us and Guests. If You book accommodation with a Us through the Site, You will be bound by the booking confirmation and the booking conditions that will apply to that booking with Us in relation to payment, cancellation and other related matters.

1.2   We reserve the right, at our sole discretion, to change, modify or otherwise alter these Terms at any time. You must review these Terms on a regular basis to keep yourself informed of any changes.

1.3   Allalin Apartments acts on behalf of the Owner(s) of the holiday accommodation (the Property Owner) for the purpose of online financial booking transaction.

1.4   If there is an inconsistency between any of the provisions of this English language version and a translated version, the provisions of the German language version shall prevail. Any translated versions of these Terms and the Terms of Use shall be for convenience only.

2.    Bookings / Reservations

2.1   Once Your booking request has been made, Your credit card will be charged with the total amount stipulated in the booking process.  We will then confirm or reject Your booking request within 36 hours of that request. If the booking request is subsequently accepted by Us, You will receive an automated email confirmation. If Your booking is rejected, You will receive an automated email with the rejection and the amount charged to your credit card will be refunded.

2.2   If the reservation confirmation differs from the description provided in Our website, You are acknowledging that the contract has been concluded on the basis of the reservation confirmation.

2.3   Bookings are in relation to accommodation and do not include transport/transfer to the property. 

2.4   If you have any special requests, We can only accept them on a non-binding basis. You have no legal right for such request to be fulfilled.

2.5   We cannot completely rule out the possibility of amendments to services or price changes before or after the booking confirmation. In case of amendments to services or price changes You will be notified. If you do not accept the changes mentioned in the notification (excluding point 2.6), You have the right to withdraw from the contract within five days of receipt of the notification without any charge.

2.6   We expressly reserve the right to effect price increases before the start of the rental period on the following grounds: raising or introduction of taxes and duties on specified services and/or changes in exchange rates after conclusion of the contract. If prices are increased by more than 10 %, you will have the same rights as detailed in point 2.5.

3.         Payment

3.1   As a Guest, You hereby authorize and agree that Allalin Apartments shall debit (whether directly or indirectly via a third party payment processor, subject to that third party’s terms and conditions) Your payment card for the amount of Your booking. You will receive a further notification email for the receipt of the payment.

3.2   The payment shall be taken by a debit or credit card which may include MasterCard & Visa Card and such payment shall be taken in the currency set by Us. Cheque payments are not accepted, and Allalin Apartments cannot be held liable for any loss of cash or cheques. You will also be asked to provide customary billing information such as name, billing address and payment information. As a Guest, You agree to pay all fees and charges contained in the booking confirmation.

3.3   In some circumstances, and in addition to the billing and payment information You provided, We may require You to produce some proof of Your identity. This can be requested at the time of booking, during payment processing or at any other time thereafter (including after You have started Your stay). We reserve the right to cancel Your booking if You do not provide such proof of identity when requested.

4         Cancelations by the Guest

·         All cancelations are subject to a CHF 50.00 administration fee

·         Bookings cancelled up to 90 days before the start of the stay will receive a 100% refund (minus CHF 50.00 administration fee)

·         Bookings cancelled between 89 and 60 days before the start of the stay will receive a 70% refund (minus CHF 50.00 administration fee)

·         Bookings cancelled between 59 and 30 days before the start of the stay will receive a 40% refund (minus CHF 50.00 administration fee)

·         Bookings cancelled between 29 and 2 days before the start of the stay will receive a 20% refund (minus CHF 50.00 administration fee)

·         Bookings cancelled 1 days before the start of the stay or now shows will not receive any refund (0%)

·         No refund for early departures

5         Cancelations and Changes by Allalin Apartments

5.1   We have the right to rescind the contract before or during the rental period if unforeseeable or unavoidable circumstances make it difficult  to hand over the rental property, endanger the Guest or the property or impair the provision of services to such an extent that it is no longer reasonable to fulfil the contract.

5.2   Alternative Accommodation: It may be necessary to make a property change for reasons such as withdrawal of a property from Our portfolio. In this event, We will attempt offer You a property of a comparable standard and price as agreed in the booking confirmation. Should the alternative property be of a higher price, We reserve the right to charge You the difference. You have the right to decline the Alternative Accommodation in which case We will fully refund You.

5.3   Our liability is limited to, and cannot exceed, the amount paid by the Guest

5.4   Allalin Apartments is under no obligation to pay compensation in any of the instance referred to in sections 5.1 & 5.2

6         Check in, Stay & Check out

6.1   The location for the handover of keys on arrival and departure will be at the Allalin Apartments office and not at the holiday chalet or apartment.

6.2   You must respect the arrival times stated in the booking confirmation, exceptions cannot be guaranteed.

6.3   The rental property must only be occupied by the specified number of people in the booking confirmation.  We may refuse to accept additional people or invoice them separately.

6.4   In the event of over-occupancy we are authorized to refuse to hand over the key and/or to terminate the contract without any refund to the Guest.

6.5   The rental property is not under any circumstances to be sublet to another party.

6.6   As a Guest, You accept responsibility for the proper conduct of all members of Your party during Your stay at the rented property. We shall be under no obligation whatsoever to pay compensation or meet any costs or expenses (including but not limited to alternative accommodation) that You may incur as a result of Your stay being terminated early due inappropriate behavior of members of Your party.

6.7   If You or the members of Your party causes any damage to the rented property, You must report it immediately to Us. You are liable for any damage caused by You or the members of Your party. The same applies if the apartment cannot be handed over to the next hirer. Any loss or damage will be offset against the security deposit.  If the damage exceeds the damage deposit, We have the right to bill You for the excess over and above the damage deposit.

6.8   Kitchen cleaning, crockery and cutlery is not included in the rental price. It is Your responsibility to clean the kitchen before Your departure otherwise CHF 100.00 will be deducted from your security deposit.

6.9   Should the condition of the property not be in accordance with the contract, You must report it to Us within 24 hours from the arrival time. If notification is not given in the stated time frame, it will be assumed that the property is free of any defects. The same rules apply if any fault occurs during the rental period.

6.10    You are further obliged not to undertake any actions which might be harmful to the house or the inventory and to immediately notify Us of anything that appears to be or is defective.

6.11    External circumstances and specific regional circumstances such as the presence of insects, stray dogs, unfavorable weather conditions or the condition of official nature trails do not entitle You to claim any kind of compensation.

6.12    We are not authorized to recognize claims or to issue legally binding statements. Any claims that cannot be settled by Us must be notified in writing to the owner within four weeks from the end of the contractual rental and the necessary evidence submitted.

6.13    If you fail to comply with the above regulations you will forfeit all rights to compensation.

6.14    You acknowledge Our Terms & Conditions and give Us the right to visit or to have the apartment inspected at any given time during Your stay.

7         Liability of Allalin Apartments

7.1  We will not be liable for loss or damage is caused by any of the following:

7.1.1          Acts or omissions on Your part or members of Your party

7.1.2          Unforeseeable or unavoidable omissions by third parties who are not involved in the provision of contractual services

7.1.3          Force majeure or events which We were unable to foresee or prevent despite exercising all due care

7.1.4          Use of swimming pools, children’s play areas, sports facilities of all kinds

7.1.5          Damage and losses resulting from theft or burglary

8         Place of jurisdiction

8.1 Where this contract does not contain specific provisions, Articles 253 to 274 of the Swiss Code of Obligations apply.

8.2 Any disputes arising from this contract underlie the jurisdiction of Visp. The determining factor is Swiss law.
